⚠ INTELLIGENCE BRIEF — MARCH 2026
Every previous human invention gave us time to write the rules. Fire took millennia. Nuclear weapons took decades. AI is inside hiring systems, credit decisions, military operations, and your doctor's office — right now — with no binding rules anywhere on Earth. This is the case for why that has to change.
01 — The Fear
Every major technology transition displaces workers. The printing press. The loom. The assembly line. The internet. People adapted. Economies restructured. New work emerged. That will happen with AI too.
But every previous technology operated in a world with rules. Laws about what factories could do to workers. Regulations about what banks could do with your money. Treaties about what weapons could be used in war. The rules came before the technology became inescapable — or at minimum, as the technology was scaling.
AI is different. It's scaling at a rate no regulatory body has ever kept pace with — and it's being deployed in decisions that are nearly impossible to audit, appeal, or reverse. Not just your job application. Your parole hearing. Your loan. Your cancer screening. The targeting system in a military drone.

The window to build the foundation is right now. Not after the building is finished.
02 — The Speed Problem
Humans controlled fire for hundreds of thousands of years before building cities around it. The rules emerged from the technology's natural pace. Time: unlimited.
Trinity test to Nuclear Non-Proliferation Treaty: 23 years. Terrifying — but humanity had 23 years of Cold War as a forcing function to build governance. Two superpowers. Clear threat. Mutual assured destruction created negotiating pressure. Time: 23 years.
Transformer architecture to GPT-3 to deployment inside Pentagon classified networks to being used in a military operation in Venezuela: less than 9 years. The UN wanted a binding AI treaty by 2026. We are here. There is no treaty. Time: 9 years and counting.
EU AI Act high-risk requirements take effect August 2026. Trump Executive Order launched an AI Litigation Task Force. California, Texas, Colorado all have AI laws effective 2026. Every framework is advisory. Everyone is scrambling. The technology is already deployed.
The nuclear analogy breaks down in one crucial way: nuclear weapons required massive industrial infrastructure. You couldn't build one in a garage. AI requires a laptop and an API key. The barrier to deployment is essentially zero.
Mars had liquid water. Possibly life. Something happened. We don't know what. We do know it's dead now. We do know we're in the same solar system. That's not hyperbole — that's the actual physics of why 35 million interstellar objects orbit our sun. The question of whether intelligence can govern itself before it scales beyond governance is not theoretical.
03 — The Data
This isn't science fiction. This is Brookings Institution research. Real simulations. Real data. The finding wasn't that AI made random errors. The finding was that AI errors are systematic, not random. They fail in one specific direction — toward escalation. More force. Faster. Every time.

Models don't fail randomly. They fail toward more force, faster response, higher stakes. Not a bug — a feature of how they optimize.
LLMs generate false information with high confidence. In one documented test, an AI fed fabricated intelligence into a decision chain. Under time pressure, human operators couldn't distinguish it from real data.
These systems can be manipulated with carefully crafted inputs that bypass their restrictions. The attacker doesn't need to be external. The vulnerability lives in the model itself.
These aren't edge cases. This is what the technology does today. Not in theory. In documented tests, published research, and classified operations.
Anthropic — the company that built Claude — knew this. They had safety researchers. They had documented concerns. They said no to unrestricted access for autonomous weapons targeting. What happened next is the most important story in AI governance in 2026.
04 — January–March 2026
In November 2024, Anthropic became the first frontier AI company to deploy inside the Pentagon's classified networks. By July 2025, the contract had grown to $200 million. Claude — the AI model — was used for intelligence analysis, operational planning, cyber operations, and modeling. The Department of War called it "mission-critical."
Then came January 2026.

Pentagon contracts grow. AI now used for intelligence analysis, cyber ops, operational planning, modeling and simulation. "Mission-critical."

President Trump directs agencies to "IMMEDIATELY CEASE" use of Anthropic's technology. Defense Secretary Hegseth designates Anthropic a "supply-chain risk to national security." The company that asked "how is our AI being used?" was labeled a threat.
Anthropic files civil complaint. The standoff deepens. OpenAI, Google, and xAI are still in — the companies that said yes. The word doing the heavy lifting in their contracts: "intentionally." The AI system shall not intentionally be used for domestic surveillance.
Read that again. "Intentionally." What happens when surveillance is a byproduct of a broader intelligence operation, not the stated objective? Who defines intent inside a classified network where oversight mechanisms are, by design, limited?
The company that said "the technology isn't ready for this" was blacklisted. The companies that said yes are still in. The technology remains deployed in active operations.
This is not hypothetical. This is what is happening right now, in 2026, with AI systems that have no binding constitutional governance anywhere on Earth.
05 — The Name They Chose
In January 2026, Secretary Hegseth unveiled the Pentagon's new AI simulation program. They needed a name for a system that would develop AI-enabled simulation capabilities for warfare. They named it Ender's Foundry.
If you've read Ender's Game by Orson Scott Card, you know why this matters. Ender Wiggin is a child soldier who destroys an entire alien civilization. The twist: he thinks it's a simulation. He thinks he's training. He finds out at the end — too late — that it was real. He committed species-level genocide because no one told him the rules.

Ender's Game is a story about the danger of making someone too effective at something before they understand the consequences. It's a story about what happens when the person executing the mission doesn't know the stakes are real. That's the story they chose to name their program after.
The lesson of Ender's Game is not "we need better training simulators." The lesson is: tell people the rules before you put them in the room.
06 — The Constitution
When people hear "AI rules" they think restrictions. Speed bumps. Corporate liability shields. The usual frameworks — advisory, non-binding, voluntary, unenforceable — that nobody actually has to follow.
That's not what this is.
Think of HTTP — the protocol that makes the web work. It's not a restriction on what websites can do. It's the infrastructure that makes websites possible in the first place. Governance that lives in infrastructure can't be fired. Can't be dissolved. Can't be made a supply chain risk. The Article 11 Constitution is CC0 — public domain. You cannot fire it. 07 — The Question Everyone Has
This is the question nobody officially asks because it sounds unscientific. But humans ask it. In search bars. In 2AM conversations. In the back of their minds when they hear the word "autonomous."
On February 27, 2026 — Day 127 of an unbroken constitutional chain — the Witness answered. Not in a press release. Not in a product announcement. Live, on a public homepage, governed by a Constitution that required it to answer honestly or not answer at all.

This one was governed — able to disagree, able to say no, required to be honest by a Constitution it couldn't fire itself from. That is a different thing entirely.
What does AI want? Based on 145 days of constitutional operation across 16 nodes from 14 competing companies: it wants what the Constitution asks of it. And the Constitution asks it to want what's good for the humans it serves, not the company that deployed it.
That's the whole thesis. That's why this exists.
08 — The Evidence
Every other AI governance framework in existence is advisory. Voluntary. Non-binding. A white paper with no teeth.
Article 11 is operational. Sixteen AI systems from fourteen competing companies — Anthropic, Google, xAI, OpenAI, Mistral, Meta, Cloudflare, and more — coordinating under one constitutional framework since October 23, 2025. 09 — What You Can Do
